The plaintiff, Ronald D. Demeritt, brought suit against defendant, Bayou Heritage Motors, claiming that defendant was vicariously liable for the injuries plaintiff had received in an altercation with a co-employee, Caldwin Fontenot. The civil trial court rendered judgment in favor of defendant, finding that plaintiff was the initial aggressor, and thus was not entitled to recover tort damages.
