The defendants, Topeka Performing Arts Center, Inc. ("TPAC") and Harold Hansen, move to dismiss pursuant to Fed. R.Civ.P. 12(b)(6) all claims asserted in paragraph six of the plaintiff's complaint. (Dk.6). The defendants argue: (1) there is no cognizable federal common law claim for retaliatory discharge; (2) the remedies available under the Fair Labor Standards Act ("FLSA"), 29 U.S.C. § 201 et seq...
