¶ 1 On December 22, 1982, Stephen Van White,1 Appellant, was charged in Okmulgee County District Court Case No. CRF-82-375 with Murder (malice aforethought) in the First Degree (Count I), Assault and Battery with Intent to Kill (Count II), Robbery with a Dangerous Weapon (Count III) and Attempted Rape (Count IV).
