This matter is presently before the court on defendants' motion to dismiss plaintiff's third amended complaint (doc. 30). Specifically, defendants move to dismiss with prejudice plaintiff's complaint for failure to comply with the pleading requirements of Rules 8(a) and 9(b) of the Federal Rules of Civil Procedure.
