FACTUAL BACKGROUND

Rudolph Mendiola was charged with three counts of aggravated sexual assault of a child and three counts of indecency with a child by sexual contact. H.A., a three and one-half year-old girl at the time of offenses, was the complainant in each count. A jury convicted Mendiola of three counts of indecency with a child by sexual contact and sentenced him to twelve years' imprisonment...
