Pending before the Court are two Motions for Summary Judgment by the Defendant. In the first Motion, the Defendant has asked for summary judgment on the Plaintiff's claims, (Doc. No. 10), and in the second, the Defendant has asked for partial summary judgment on its cross-claims. (Doc. No. 13.)
