Plaintiff Gateway 2000, Inc. ("Gateway") sues its former employee Tim R. Kelley ("Kelley") to enforce the covenants of a non-compete agreement Kelley signed. Also implicated in the present action is Gateway's related suit to enforce a non-compete agreement against Jeffrey Livak ("Livak"), Kelley's direct supervisor for most of his tenure at Gateway.
