This matter is before the Court on the motion of Defendant, Bank One, N.A. ("Bank One"), for partial judgment on the pleadings pursuant to Federal Rule of Civil Procedure ("Rule") 12(c). Bank One moves for judgment on the pleadings on Count I of the Amended Complaint filed by Plaintiff, the Pension Benefit Guaranty Corporation ("PBGC").
