On the night of December 16, 1996, the owner of a service station called police after he observed appellant James Edward Jenkins enter the station building through a broken window after business hours. When officers arrived minutes later, they found Jenkins sitting on the floor behind the counter and a bag of copper piping near the counter out of its normal position in the back room.
