This matter comes before the Court on cross-motions for summary judgment filed by plaintiffs Brian Todaro, et al., and defendant Township of Union. The Court has decided this matter pursuant to Federal Rule of Civil Procedure 78. For the reasons set forth herein, plaintiffs' motion for summary judgment on count one of the amended complaint will be denied. Defendant's motion for summary judgment will be held in abeyance...
