IT IS HEREBY ORDERED that Defendants' Motions for Summary Judgment (dkt.# 51, 52) are GRANTED, and that judgment is entered in favor of Defendants and against Plaintiff as to Plaintiff's federal law claims;

IT IS FURTHER ORDERED that Plaintiff's state law claims are DISMISSED without prejudice;
