This case arises out of a disagreement over the disposition of assets in a trust created for the benefit of Frances Franzen by her late husband, James Franzen. In Norwest Colorado v. Franzen, No. 95CA0386 (Colo.App. June 27, 1996) (not selected for publication), the court of appeals held that James O'Brien, Mrs. Franzen's brother, was authorized to dissolve the trust by virtue of a power of attorney executed...
