FACTS AND PROCEDURAL BACKGROUND

On May 12, 1995, an information was filed charging Paul Wyatt with burglary, I.C. § 18-1401, and being a persistent violator, I.C. § 19-2514. Wyatt entered a plea of not guilty and the district court set the trial date for August 15, 1995. Wyatt was released on his own recognizance pending trial.
