The plaintiffs allege that the Local 875 I.B.T. Pension Fund ("the Fund") has been defrauded of $9.3 million — over 20 percent of its assets because it was induced to devote that sum to an investment plan that was actually a scheme to steal the money through financial subterfuge. They seek recovery under the Section 10(b) of the Securities Exchange Act of 1934, 15 U.S.C. § 78j(b), and Rule 10-5 promulgated...
