Willis brought this lawsuit alleging that defendant Quality Mortgage USA, Inc. charged them fees for services which were not performed or were not necessary, in violation of the Real Estate Settlement Procedures Act (RESPA), 12 U.S.C.A. § 2607, and imposed an illegal penalty for prepayment, in violation of § 5-19-4 of the 1975 Code of Alabama.
