Michael Cherry was indicted by a Cherokee County grand jury on one count of sale of cocaine and one count of possession of cocaine with intent to distribute. OCGA § 16-13-30(b). He was convicted by a jury, and his motion for new trial was denied. Cherry's motion for an out-of-time appeal was granted by the trial court, and he appeals.
