This matter comes before the court on cross-motions for summary judgment (Docs. 65 & 74). The parties have filed various documents in support and opposition to the motions (Docs. 75, 76, 77 & 78). For the reasons stated below, the court grants the motion of defendants Boles and Odle (Doc. 74), and denies the motion of Marrs (Doc. 65).
