Timothy Whaley seeks to avoid serving a sentence of incarceration arising out of his plea of guilty to a violation of his supervised release. The Bureau of Prisons believes he may be entitled to credit against Whaley's sentence the time he previously spent incarcerated on the underlying conviction, which was later declared partially illegal.
