Magnetic Resonance Plus, Inc. ("MRP") sued North Georgia Diagnostic Imaging, Ltd. and its managing agent Imaging Systems International, Inc. (collectively "NGDI") for breach of contract arising out of NGDI's prematurely terminating its contract with MRP. Following a bench trial, the judge awarded MRP damages equal to MRP's anticipated profit on the contract, despite a contract provision prohibiting MRP from recovering "any lost profits."
