Before the court is Defendant's Motion for Summary Judgment. For the following reasons, the motion is granted.

Defendant, Alex's Transportation, Inc. ("Alex's"), contracts with a number of major railroad companies to provide crew hauling services. Alex's drivers haul railroad crews from (1) railyard to railyard, (2) hotels to railyards, and (3) hotels and railyards to trains at random...
