McClelland ("McClelland"), brings this diversity of citizenship action pursuant to the tort laws of Georgia against Defendant, Jennifer Lynn Riffle ("Riffle"), Currently before the Court is Riffle's Motion for Summary Judgment under Rule 56 of the Federal Rules of Civil Procedure. For the following reasons, Riffle's motion will be DENIED.
