On April 9, 1997, Ralph Barke submitted to the court a petition for a writ of habeas corpus, pursuant to 28 U.S.C. § 2254, along with an application for leave for proceed in forma pauperis. He did not submit the $5.00 filing fee required by 28 U.S.C. § 1914(a). The clerk of court stamped the word "filed" on both the petition and the application to proceed in forma pauperis on that day.
