Penn-Plax, Inc. ("Penn-Plax") has sued L. Schultz, Inc. d/b/a Lee's Aquarium & Pet Products ("Lee's") for false advertising in violation of § 43(a) of the Lanham Act, 15 U.S.C.A. § 1125(a) (1998), and the Maryland Consumer Protection Act, Md.Code Ann., Com. Law § 13-408 (1990). Now pending are the defendant's motions to dismiss the complaint, to transfer venue to the Southern District of California...
