ECHOLS, District Judge.

Presently pending before the Court is Defendant's Motion for Summary Judgment, to which Plaintiff has responded in opposition. Plaintiff has also filed a Cross-Motion for Summary Judgment, to which Defendant has responded in opposition. For the reasons outlined herein, Defendant's Motion is DENIED and Plaintiff's Motion is GRANTED.
