Appellant, Jackie Eugene Humphreys,1 was tried by jury and convicted of one count of Murder in the first degree (21 O.S.Supp. 1982, § 701.7(A)) in the District Court of Okmulgee County, Case No. CRF-87-5001, the Honorable Anne Moroney, District Judge, presiding. The jury found three (3) aggravating circumstances2
