Allen D. Fales appeals the judgment of the district court for Custer County following a jury trial. This case involves a malpractice claim made by Fales on behalf of his infant son, Colton W. Fales, alleging that N. Leon Books, M.D. (Dr. Books), was negligent in his use of forceps to assist during the delivery of Colton.
