Defendant appeals after his conviction by a jury for sodomy, § 566.060, RSMo Supp. 1992, and assault in the third degree, § 565.070, RSMo Supp.1992. The court found defendant to be a persistent and class X offender and sentenced him to concurrent prison terms of fifteen years for sodomy and one year for assault.
