Defendants filed a motion requesting that the Court reconsider its ruling of February 5, 1997 on defendants' motion to dismiss plaintiff's complaint, or in the alternative, certify the matter for appeal pursuant to 28 U.S.C. § 1292(b). For the reasons set forth in this memorandum, the Court will reconsider its decision and dismiss Count III of plaintiff's complaint. The Court will deny defendants' motion to dismiss Counts...
