Before the Court is Defendant PepsiCo Puerto Rico, Inc.'s ("PepsiCo") motion to dismiss this claim for lack of subject matter jurisdiction. PepsiCo is incorporated in Delaware. It operates in the food and restaurant business in Puerto Rico.
