On November 9, 1993, Moynihan filed a claim for workers' compensation disability benefits as a result of an accident alleged to have occurred on March 29, 1991.

The employer/self-insurer, Queen Carpet, Inc., asserted as one of its grounds of defense that Moynihan's claim is barred by the statute of limitation in OCGA § 34-9-82(a). It provides: "[t]he right to compensation shall be barred unless a claim therefor is filed within one...
