Presently pending is the defendant District of Columbia's motion to dismiss or, in the alternative, for summary judgment. Because the parties have not submitted materials beyond the pleadings for the Court's consideration and because discovery has not commenced, the Court will not convert the defendant's motion to dismiss to a motion for summary judgment.
