POPOVICH, Judge.
This is an appeal from the order of the Court of Common Pleas of Luzerne County dismissing appellant's first petition, pro se, for post-conviction relief without appointment of counsel. On appeal, appellant's sole contention is that the lower court erred in denying him the right to counsel to assist him in his petition. We agree, and, therefore, remand for the appointment of counsel.
