The sole issue on this appeal is whether the district court erred in denying Alexander Montanez the benefit in sentencing of the recently enacted "safety valve" provision which relates to mandatory minimum sentences. 18 U.S.C. § 3553(f); see U.S.S.G. § 5C1.2.
