ORDER

EDENFIELD, Chief Judge.

Plaintiff A/S Dan Bunkering Ltd. ("DB") brought suit against the M/V Zamet to recover payment for bunker fuel it supplied the Zamet. Claimant Losinjska Plovidba-Brodarstvo ("Losinjska"), the Zamet's owner, defends the action. This case was dismissed pursuant to a settlement, but it was never consummated. Thus, the dismissal order was vacated, thereby resurrecting the cross motions for summary judgment.
