INTRODUCTION

On May 17, 1995, Willie and Jacquelyn Thomas ("Plaintiffs") filed their complaint in the Circuit Court of Lowndes County, Alabama, against Jim Walter Homes, Inc., ("Jim Walter") and Anthony O. Henry. The Plaintiffs and defendant Henry are Alabama citizens, and Jim Walter is a foreign corporation doing business in Alabama. The Plaintiffs' complaint contained six counts....
