This matter is before the court on a motion to dismiss for lack of jurisdiction pursuant to USCIT Rule 12(b)(1). Defendant argues that the court lacks jurisdiction over the entry in issue because plaintiff Leland Stanford Junior University ("Stanford") failed to file a protest after reliquidation and the reliquidation of the entry has become final and conclusive.
