ORDER
NUGENT, District Judge.
Pursuant to the Memorandum and Opinion filed simultaneously herewith, this Court holds that there is no genuine issue as to any material fact and that Defendants are entitled to summary judgment in their favor as a matter of law pursuant to FED.R.CIV.P. 56(c).
