This matter comes before this Court upon an Application for Leave to File Motion to Vacate Conviction and/or Death Sentence pursuant to our Post-Conviction Collateral Relief Statute, Miss. Code Ann. § 99-39-1, et seq. (Supp. 1994). The crime underlying Foster's petition for relief is the shooting of a store clerk, George Shelton, during the commission of a robbery. See Foster v. State, 639 So.2d 1263
