WRIGHT, Justice.

Charles Monroe d/b/a Delta Bail Bonds (DBB) brought suit against William Frank (Frank) seeking to recover on an indemnity contract related to a bail bond. Frank counterclaimed under the Texas Debt Collection Practices Act (the Act). See TEX. REV. CIV. STAT. ANN. art. 5069-11.01-11.12 (Vernon 1987 & Supp.1996). When the case was called to trial, DBB nonsuited its claims. A bench trial then proceeded on Frank's counterclaim...
