MEMORANDUM OPINION AND ORDER

WINGATE, District Judge.

Before the court are the motion for partial summary judgment submitted by the plaintiff, Fidelity and Guaranty Insurance Company, and the cross-motion for partial summary judgment submitted by the defendant, Craig-Wilkinson, Inc. Jurisdiction of this matter is predicated upon Title 28 U.S.C. § 13321 (diversity of citizenship).
