This matter comes before the Court on Defendants' Motion for Summary Judgment, pursuant to Fed.R.Civ.P. 56. The issues before the Court concern whether Defendants' employee benefit plan is exempt from the fiduciary duty provisions of the Employee Retirement Income Security Act of 1974 ("ERISA"), 29 U.S.C. §§ 1001, et seq., and whether Plaintiff's state law claims are preempted by ERISA.
