MEMORANDUM OF OPINION AND ORDER

This matter is before the Court upon MedCentral Health System's Motion for Summary Judgment (Doc. # 43). Previously, Defendant filed a Motion to Dismiss Third Cause of Action (Doc. # 32). For the reasons that follow Defendant's Motion for Summary Judgment is GRANTED and Defendant's Motion to Dismiss Third Cause of Action is DENIED as moot.
