The sale was the result of an action to foreclose a preferred ship's mortgage held by the Plaintiff, USL Capital, against the Defendant vessel, the New York 30, and to recover the amount due under the Mortgages against the Vessel owner, New England Marine Services (NEMS) and other defendants in personam.
