A jury found appellant, Manuel Serrano, guilty of driving while intoxicated. Act of May 28, 1923, 38th Leg., 2nd C.S., 1923 Tex. Gen. Laws 56, repealed by Act of May 29, 1993, 73rd Leg., R.S., ch. 900, § 1.15, 1993 Tex. Gen. Laws 3704 (current version at TEX. PENAL CODE ANN. § 49.04 (Vernon 1994 & Supp.1996)).
