DARDEN, Judge.

STATEMENT OF THE CASE

The Indiana State Police (ISP) appeals the trial court's denial of its motion for summary judgment in the action filed by Don's Guns & Galleries, Inc. (Don's Guns) against ISP.

We reverse.
