LEE, Justice.

Appellant entered a plea of not guilty before a jury to the offenses of aggravated kidnapping and aggravated assault. Tex. Penal Code Ann. §§ 20.04; 22.02 (Vernon 1994 & Supp.1996). He was convicted of only assault. Id. § 22.01. The court assessed punishment at one year in jail.
