The defendant, David Allen Mackey, was charged by a grand jury with second degree murder, a violation of La.R.S. 14:30.1. A trial by jury began on August 24, 1994, and ended on August 25, 1994, with the jury returning a verdict of guilty as charged. The defendant was subsequently sentenced to life imprisonment at hard labor without benefit of probation, parole, or suspension of sentence, and he has appealed his conviction.
