Larochelle was tried on a five-count indictment and was convicted only of one count of trafficking in cocaine through the knowing possession of 400 grams or more. OCGA § 16-13-31(a)(1)(C). He was sentenced to 25 years' imprisonment and ordered to pay a $1,000,000 fine. His motion for new trial was denied. Among other things, he contends that the five-count indictment was vindictive, that a plea offer was not communicated to him by trial...
