In the instant prosecution, defendant Adolfo L. Gutierrez is charged with possession of cocaine with the intent to distribute, and conspiracy to possess cocaine with the intent to distribute, in violation of 21 U.S.C. §§ 841(a)(1) and 841(b)(1)(B)(ii), and 18 U.S.C. § 2.
