Leonardo Martinez was charged by information with two counts of first degree sexual assault, in violation of Neb.Rev.Stat. § 28-319 (Cum.Supp.1994), and one count of sexual assault of a child, in violation of Neb.Rev. Stat. § 28-320.01 (Cum.Supp.1994). After a jury trial, Martinez was convicted of one count of first degree sexual assault. The two other counts mentioned above were not submitted...
